DELIVERY TERMS

Passion HQ delivers Worldwide via our online platform.

Passion HQ shall endeavor to have all orders delivered within 10 to 15 working days (unless stated local stock your order will ship the following business day - for South Africa consumers only) of the order being placed in South Africa. However, the delivery time may vary depending on external factors beyond Passion HQ control.

Following the developments related to - Corona Virus - COVID-19, we would like to inform you that we are working around the clock to ensure that there are minimal delays and interruptions of our services. Accordingly, depending on the origin and destination, you may experience a delay in delivering your orders. We are closely monitoring the new regulations and policies set by government and transportation authorities which may have an impact on our normal operations, and we will keep you updated. The health and safety of our customers and our team is our highest priority, and we are taking the necessary measures following the recommendations of the World Health Organization and local public health authorities, to ensure we continue to serve you with zero compromise on the well-being of all parties.

Delivery by Passion HQ offered via free courier delivery to your door anywhere in South Africa. All orders will be processed after payment is cleared. All products are delivered from our international warehouse, unless stated differently in some cases - "The words Local Stock will be displayed in the details and description of the item". Due to the nature of our online store, overselling may occur and the item may be out of stock and might take longer to be delivered as we wait for the warehouse to restock. Should the ordered item be out of stock and not being restocked again we will send you an email and you can choose another item of the same value or we will process a refund. Processing time may vary from 3-4 days on average depending on the dispatch load. Please take note: Delivery will take anywhere from 10-15 business days. Please take note on rare occasions there may be a slight delay due to custom clearance and international holidays. Delivery time does not include processing time. Delivery times do not include Saturdays, Sundays or public holidays. Orders with incorrect delivery information, or requiring additional verification, will be delayed. In the case of returned delivery, the customer is responsible for any and all additional fees incurred for delivery.

Passion HQ shall not be liable for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

Deliveries may be delayed due to force majeure, logistical, promotional and other considerations.

Delivery is subject to a confirmed proof of payment of an order and Passion HQ shall not be liable for any delays, damages, costs, theft or loss of parcels caused by external factors, including but not limited to, customs clearance & inspections, transporters, deliverers, charges or expenses arising out of hijacking or unforeseen road accidents of third party delivery vehicles, resulting in the loss or damage to parcels or late deliveries, delayed flights, political conflicts, acts of God, force majeure and others. Risk on delivery shall pass to the consumer upon handing the parcel over to our delivery company, unless the consumer arranges to have the goods picked up or employs the services of his/her own delivery company, in which case risk shall pass to the consumer upon collection of the goods

All prices stated on Passion HQ website include customs duties, taxes, and government levies for all orders being delivered in South Africa relating to purchases on the Passion HQ website or online platform.

While Passion HQ endeavor at all times to adhere to previously stated delivery times and schedules of 10 to 15 working days, during promotions, special sale events and international holiday breaks delivery times and schedules may be varied due to the influx of customer orders.

During such holiday periods, promotions and promotional events, delivery of goods shall be 10 to 18 working days from date of confirmation of order but may be delivered before such time. Deliveries may be delayed due to force majeure, logistical, promotional and other considerations.

Where stock is sold out due to the above factors, Passion HQ shall endeavor to assist customers by offering similar goods or products or store credit or refund in lieu of such shortages.

No deliveries shall be made to P.O Boxes or LOT No’s or outlying areas which are not accessible by delivery companies. The onus remains with the Consumer to ensure that an accessible physical address is provided. In some outlaying areas orders may be placed in PUDO lockers and PIN code supplied to the customer.

The Consumer has a duty to ensure that the goods are inspected upon delivery, and to notify Passion HQ in writing within 24 hours of any defects, damages or incorrectly supplied goods.

Should the item be damaged, the item needs to be received by Passion HQ within (5 calendar days) in its original packaging, and upon receipt and inspection of the damaged item a final decision will be made by Passion HQ to offer either a replacement or store credit for the total cost of the item minus shipping costs and communicated to the consumer accordingly in writing.

Delivery charges shall be detailed with each individual order and may differ based on the size, type and quantity of goods ordered by the Consumer or Retailer.

The User or Consumer agrees and accepts that should the he/she change the order, delivery address or specifications after an order has been dispatched, then there shall be delays with the date and time of delivery based on logistical considerations. Any request to change an order that has been placed must be done via email and this will result in a 24-48-hour delay.

DELIVERY CHARGES

Passion HQ offers free delivery within South Africa for all orders to any value.

All prices quoted to any country excluding South Africa excludes any additional customs and duties charges that may be applicable for which the responsibility will fall onto the buyer to settle.

DELIVERY

Promotions and Special Sale Events

While Passion HQ endeavors at all times to adhere to previously stated delivery times and schedules of 10-15 working days, during promotions and special sale events delivery times and schedules may be varied due to the influx of customer orders. During such promotions and promotional events, delivery of goods shall be 10 to 18 working days from date of confirmation of order but may be delivered before such time. Tracking numbers are provided once an order is fulfilled and will not be Tracked by Passion HQ due to the amount of orders being placed. Upon receiving a tracking number it is the customer's responsibility to track and trace. If at any time you suspect their is an issue with your delivery please contact us immediately and we will follow up with the logistics companies.

CANCELLATION POLICY

The Consumer may at any time prior to the order being finalized and confirmed online via completion of the transaction, cancel the order at no charge to him or her. Once the order has been confirmed and finalized however, Passion HQ reserves the right to charge a reasonable handling or administrative charge which may be up to 35% of the purchase price of the goods in accordance with the Consumer Protection Act (the “CPA”)

Passion HQ reserves the right to cancel any order where there is suspicion of fraud, misconduct or other criminal activity and to refuse the supply of goods in such circumstances.

The Consumer may not unilaterally cancel the transaction, subject to the terms of the Returns Policy in Clause 7 above. All cancellation of orders must be done in writing from the account holder related to the purchase and refunds shall take 7-14 working days to process. 

If cancellations are done after an order has been shipped, the customer shall be refunded only once the order has been returned and validated in the warehouse at Passion HQ and that account holder may be liable for shipping charges.

VOUCHERS, COUPONS AND PROMOTIONS

Vouchers, Coupons, Gift Cards including online promotions, competitions and Hashtags may only be used to discount regularly priced items on the Website or Online Platform.

These are not applicable to already discounted or marked down products. These are single use only and may be used by one person for the purposes of a single transaction.

Passion HQ reserves the right to revoke and cancel any vouchers, coupons, gift cards or other discounts should there be a suspicion of fraud, misuse or abuse. Vouchers, Coupons and Gift Cards are valid for a specified period only and may not be exchanged for cash.

These may only be used for goods available on the Website or Online Platform and may not be redeem at Agents, Subsidiaries or Assigns of Passion HQ The total basket value of the purchase must be the stated promotional value or more.

This may constitute a single item, or multiple items totaling the stated promotional value or more. Should the consumer return one or more item after having received the discount value from the promotion, thereby dropping the total basket value or total value of the purchase to below the stated promotion or value, then that consumer shall be liable for charges as determined by Passion HQ All promotions shall only be valid for the stipulated period of that promotion or in the absence of any time frame, shall be valid for a maximum of 7 (seven) days from date of promotion to midnight on the 7th (seventh) day thereafter including all Sundays and public holidays. Multiple vouchers are not allowed be used on the same order. Any product bought using a discount code or that is discounted and then returned will be refunded the actual amount paid for the product including any transport charges that may occur.

Passion HQ cannot warrant that special prices, promotions, promotional codes and vouchers will work on all computers, laptops, operating systems and personal devices and all platforms for all customers.

ABUSE OF ACCOUNTS, VOUCHERS, PROMO CODES AND GIFT CARDS:

User and Consumers are identified by their personal information including names, handles, cell phone numbers, email addresses physical address and other identifying markers.

Should Passion HQ find that a user or consumer has attempted or abused the system by creating multiple accounts, stacking promo codes, adding and removing items from the basket to trigger free delivery and thereafter removing items or otherwise abusing the system, Passion HQ shall take all necessary steps including banning the user, closing the accounts, revoking the order and/or the instituting of civil or criminal proceedings should the situation warrant it.

FREE GIFT GIVE AWAY TERMS:

Our free gift campaigns are subject to consumers spending a certain amount and is subject to the following clause:

The total basket value of the purchase must be to the stipulated reward amount or more. This may constitute a single item, or multiple items totaling the stipulated amount or more.

Should the consumer return one or more item after having received the free gift, thereby dropping the total basket value or total value of the purchase to below the stipulated reward amount then that consumer shall be liable for charges as determined by Passion HQ.

Passion HQ reserves the right to levy charges at its discretion where there has been abuse or misuse by consumers of the free gift offer.

BUNDLE DEALS, COMBINATION DEALS AND PROMOTIONS:

Bundle, Combination and Promotions campaigns are subject to consumers spending a certain amount and is subject to the following clause:

The total basket value of the purchase must be to the stipulated reward amount or more. This may constitute a single item, or multiple items totaling the stipulated amount or more.

Should the consumer return one or more item after having received the promotion, thereby dropping the total basket value or total value of the purchase to below the stipulated reward amount then that consumer shall be liable for charges of the product and transport changes as determined by Passion HQ.

Passion HQ reserves the right to levy charges at its discretion where there has been abuse or misuse by consumers of the promotion offer.

SPECIAL MARK DOWN AND CLEARANCE SALES:

Passion HQ may at times offer items to consumers on special markdown or clearance sales. During such times Passion HQ reserves the right not to accept returns/exchanges or process refunds on items purchased during such sales.

Where Passion HQ chooses at its sole and exclusive discretion to accept a return or refund at a markdown or clearance sale, the customer shall be liable for any and all associated costs including transportation and handling charges.

MISUSE OR ABUSE:

Passion HQ reserves the right, at the sole and exclusive discretion of management to:

Limit or restrict all access to users of the Passion HQ website, social media pages, mobile app or mobile platforms.

Suspend or ban users from accessing its website, social media pages, mobile app or mobile platforms.

Delete or remove any comments, statements or posts by users which may have the effect of bring Passion HQ, its brand, company, staff or directors into disrepute.

Record, including by way of recording or screen captures any posts which may be defamatory, slanderous or which may otherwise have legal implications for users.

Take any other action which has the effect of mitigating or limiting representational damages or defamatory conduct.

COMPETITION TERMS:

Passion HQ may from time to time run competitions and promotions for users of the website and online platform and for consumers. The following terms shall apply to all competitions unless specifically stated otherwise. Should there be conflict between stated competition terms on the website and online platform and these terms, then these terms shall take precedence.

No entry fee shall be levied for competitions unless otherwise stated in that competition and subject to the limitations of the Consumer Protection Act of 2008.

Passion HQ shall not accept responsibility for entries not being received for any reason whatsoever, including incorrectly filled out forms, network problems or others.

While Passion HQ shall endeavor to ensure that prize descriptions are clear and set in ordinary terms, Passion HQ shall not be liable for the user or consumer incorrectly understanding the prizes offered or the entry requirements. Furthermore, Passion HQ cannot guarantee the accuracy or details of prizes which are supplied by third parties or suppliers of Passion HQ.

All competitions winners shall be randomly selected. However, the final selection remains the sole and exclusive discretion of Passion HQ and its management.

Employees, staff, affiliates, partners and services providers of Passion HQ shall not be eligible for entry into competitions.

There shall be one winner per competition unless specifically stated otherwise.

Competition winners agree to have their likeness, image, name and winning details published by Passion HQ or its affiliates including the publication in any promotional material.

Competition prizes shall be delivered to the winners, or shall be collected by the winners at Passion HQ offices only. The winners may be required to provide contact details, personal information and/or proof of identity prior to receiving their prizes.

Competition prizes cannot be exchanged for cash, other items, colors or specifications or returned for credit.

Passion HQ may differ or cancel competitions at its sole and exclusive discretion for any reason whatsoever.

Competition winners will be notified electronically on the platform that they entered or via email and must contact Passion HQ within 7 (seven) working days of being notified, failing which the winner shall forfeit the prize and which prize may thereafter be awarded to the next potential winner.

Competition entries shall only be accepted within the period of the competition and shall close on midnight on the last day of that competition. Should there be no stipulated end date, all competitions shall run for a maximum of 14 (fourteen) days from beginning of the contract till midnight on the 14th(fourteenth) day, including all Sundays and public holidays.

Prizes shall be delivered within the ordinary delivery times and shall be delivered to the address provided by the competition winner.

Entry into all competitions shall be deemed as acceptance of all the terms above.
